Educational Technology Terms

Classroom Pulse is an educational technology platform designed specifically for behavior observation and data collection in K-12 educational settings. These terms reflect our commitment to supporting educators while protecting student privacy and maintaining compliance with educational regulations.

1. Agreement to Terms

By accessing or using Classroom Pulse ("Service," "Platform," or "Application"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a school, district, or educational organization, you represent that you have the authority to bind that entity to these Terms.

These Terms constitute a legally binding agreement between you (and your organization) and Classroom Pulse. If you do not agree to these Terms, you may not access or use the Service.

2. Service Description

Classroom Pulse provides a comprehensive behavior tracking and analysis platform designed by school psychologists and behavior specialists for educational professionals. Our Service includes:

  • Behavior frequency, duration, and intensity tracking tools
  • Functional Behavior Assessment (FBA) data collection
  • Behavior Intervention Plan (BIP) monitoring and support
  • Progress monitoring and reporting for IEP goals
  • AI-powered insights and predictive analytics
  • Secure parent communication and report sharing
  • Team collaboration features for educational staff
  • Professional development resources and training materials

3. User Eligibility & Accounts

Eligibility Requirements

  • You must be 18 years or older to create an account
  • You must be an authorized educational professional or parent/guardian
  • Student accounts are not permitted (educators manage student data)
  • You must provide accurate, current, and complete information

Account Types

  • Educator Accounts: For teachers, specialists, and support staff
  • Administrator Accounts: For school/district administrators with oversight responsibilities
  • Parent Access: Time-limited access through secure email links (no account required)
  • Team Member Accounts: For collaborative staff with designated permissions

Account Security

  • You are responsible for maintaining the confidentiality of your login credentials
  • You must immediately notify us of any unauthorized access or security breach
  • You are liable for all activities that occur under your account
  • We recommend using strong, unique passwords and enabling two-factor authentication when available
  • Sharing accounts or credentials is strictly prohibited

4. Acceptable Use Policy

Permitted Uses

You may use Classroom Pulse to:

  • Track and analyze student behavioral data for educational purposes
  • Support IEP/504 plan development and monitoring
  • Generate reports for educational decision-making
  • Communicate with parents about student progress
  • Collaborate with educational team members
  • Access professional development resources

Prohibited Uses

You may NOT use the Service to:

  • Violate any applicable laws, including FERPA, COPPA, or state privacy laws
  • Share, sell, or disclose student data to unauthorized parties
  • Use student data for non-educational or commercial purposes
  • Discriminate against or stigmatize any student
  • Create false or misleading behavioral records
  • Attempt to access data of students not under your authorized supervision
  • Reverse engineer, decompile, or attempt to extract the source code
  • Use automated systems or bots to access the Service
  • Transmit viruses, malware, or other harmful code
  • Impersonate another user or misrepresent your affiliation

5. Student Data & Privacy

Data Ownership

  • Schools and educational institutions retain ownership of all student data
  • We act as a service provider and data processor on behalf of schools
  • You grant us a limited license to process data solely to provide the Service
  • We will never claim ownership of student educational records

FERPA Compliance

  • We comply with the Family Educational Rights and Privacy Act (FERPA)
  • We will not disclose student records without proper authorization
  • Schools are responsible for obtaining necessary consents from parents/guardians
  • We provide tools for FERPA-compliant data management and reporting

Data Use Restrictions

  • Student data will only be used for authorized educational purposes
  • We will never sell student data or use it for advertising
  • We will not create commercial profiles of students
  • Data will be deleted upon school request or contract termination

6. Subscription Plans & Payment

Available Plans

  • Free Plan: Limited to 1 student, basic features
  • Essential Plan: $14.99/month for up to 15 students
  • Professional Plan: $39.99/month for up to 30 students with team features
  • District Plan: Custom pricing for unlimited students and users

Billing Terms

  • 14-day free trial available for all paid plans (no credit card required)
  • Subscriptions automatically renew unless cancelled
  • Annual plans available with 20% discount
  • Payment processing handled securely by Stripe
  • School purchase orders accepted for annual subscriptions
  • Prices subject to change with 30 days notice

Refund Policy

  • 30-day money-back guarantee for all paid plans
  • Prorated refunds for annual plans cancelled mid-term
  • No refunds for partial monthly periods
  • Refund requests must be submitted to billing@classroompulse.io

7. Intellectual Property Rights

Our Intellectual Property

All content, features, functionality, and technology comprising the Service are owned by Classroom Pulse and protected by copyright, trademark, and other intellectual property laws, including:

  • Software code and algorithms
  • User interface designs and graphics
  • Behavioral tracking methodologies
  • AI models and analytics systems
  • Documentation and training materials
  • Classroom Pulse name, logo, and branding

Your Content

  • You retain ownership of content you create using the Service
  • You grant us a limited license to host and process your content
  • This license is solely for providing and improving the Service
  • You are responsible for ensuring you have rights to all content you upload

Feedback & Suggestions

Any feedback, suggestions, or ideas you provide about the Service become our property and may be used without compensation or attribution to improve our platform for all users.

8. Third-Party Services & Integrations

The Service may integrate with or link to third-party services. Your use of such services is governed by their respective terms and privacy policies.

Current Integrations

  • Google Workspace: For educator authentication and document export
  • Clever: For single sign-on and rostering (coming soon)
  • Student Information Systems: For roster sync (varies by district)

We are not responsible for third-party services' practices, content, or availability. Schools should review third-party terms before enabling integrations.

9. Service Availability & Support

Service Level

  • We strive for 99.9% uptime during school hours
  • Scheduled maintenance performed during non-school hours
  • Emergency maintenance notifications provided when possible
  • Service may be temporarily unavailable for updates or repairs

Support Services

  • Free Plan: Community support and documentation
  • Essential Plan: Email support (48-hour response)
  • Professional Plan: Priority email support (24-hour response)
  • District Plan: Dedicated support with phone access

10. Disclaimers & Limitations

Educational Tool Disclaimer

Classroom Pulse is an educational support tool. It does not replace professional judgment, clinical assessment, or specialized educational services. Users should:

  • Use the Service as one component of comprehensive educational planning
  • Consult qualified professionals for clinical or diagnostic decisions
  • Verify all data and reports before making educational decisions
  • Comply with all applicable educational and professional standards

Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DATA.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLASSROOM PULSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, EDUCATIONAL OPPORTUNITIES, OR INSTITUTIONAL REPUTATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Classroom Pulse, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising from:

  • Your violation of these Terms
  • Your violation of any third-party rights, including privacy rights
  • Your violation of any applicable laws or regulations
  • Any content or data you submit through the Service
  • Your negligent or intentional misconduct

12. Termination

Termination by You

  • You may cancel your subscription at any time through account settings
  • Cancellation takes effect at the end of the current billing period
  • You may request immediate account deletion and data removal
  • Schools may request bulk data export before termination

Termination by Us

We may suspend or terminate your account if you:

  • Violate these Terms or our Acceptable Use Policy
  • Fail to pay subscription fees when due
  • Engage in conduct harmful to other users or the Service
  • Use the Service for unauthorized or illegal purposes

Effect of Termination

  • Access to the Service will cease immediately
  • Data will be available for export for 30 days post-termination
  • After 30 days, all data will be permanently deleted
  • No refunds for unused portions of subscriptions (except as required by law)

13. Dispute Resolution

Informal Resolution

Before filing any formal dispute, you agree to attempt to resolve disputes informally by contacting us at legal@classroompulse.io. We will attempt to resolve disputes informally for 60 days.

Arbitration Agreement

If informal resolution fails, disputes will be resolved through binding arbitration under the American Arbitration Association rules, except where prohibited by law. This includes disputes about the validity of this arbitration agreement.

Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class actions, class arbitrations, or representative actions.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. For any disputes not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts in Texas.

For schools and districts, we acknowledge that some provisions may be superseded by applicable state education laws and regulations.

15. Modifications to Terms

We may modify these Terms at any time. When we make material changes:

  • We will notify you via email at least 30 days before changes take effect
  • We will post the updated Terms with a new effective date
  • Your continued use after the effective date constitutes acceptance
  • If you disagree with changes, you may terminate your account

For schools with active contracts, material changes will not take effect until contract renewal unless mutually agreed.

16. General Provisions

Entire Agreement

These Terms, along with our Privacy Policy and any school agreements, constitute the entire agreement between you and Classroom Pulse.

Severability

If any provision is found unenforceable, the remaining provisions will continue in effect, and the unenforceable provision will be modified to be enforceable.

Assignment

You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.

Force Majeure

Neither party is liable for delays or failures due to causes beyond reasonable control, including but not limited to acts of God, natural disasters, pandemics, or government actions.

Acknowledgment

By using Classroom Pulse, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you are using the Service on behalf of a school or district, you represent that you have the authority to agree to these Terms on their behalf.
