DMCA Policy

ClassroomPulse respects the intellectual property rights of others and expects our users to do the same. This Digital Millennium Copyright Act ("DMCA") Policy outlines our procedures for addressing claims of copyright infringement.

1. Intellectual Property Rights

ClassroomPulse respects intellectual property rights and expects all users to comply with copyright laws. We will respond to notices of alleged copyright infringement that comply with the DMCA and other applicable laws.

As an educational platform, we recognize the importance of fair use in educational settings. However, this does not exempt users from copyright obligations when uploading or sharing content.

3. Reporting Copyright Infringement

3.1 Filing a DMCA Notice

To file a notice of alleged copyright infringement, you must provide a written communication that includes:

  1. Identification of the copyrighted work - A description of the copyrighted work you claim has been infringed, or if multiple works, a representative list
  2. Identification of infringing material - Description of the material you claim is infringing and its location on our service, with enough detail for us to locate it
  3. Contact information - Your address, telephone number, and email address
  4. Good faith statement - A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
  5. Accuracy statement - A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner
  6. Signature - Physical or electronic signature of a person authorized to act on behalf of the copyright owner

3.2 Notice Requirements

Important: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees.

4. Counter-Notification Procedure

4.1 Filing a Counter-Notice

If you believe your content was removed in error, you may file a counter-notification. The counter-notification must include:

  1. Identification of removed material - Description of the material that was removed and its location before removal
  2. Good faith statement - A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification
  3. Consent to jurisdiction - Statement consenting to the jurisdiction of Federal District Court for your judicial district
  4. Service acceptance - Statement that you will accept service of process from the person who provided the original DMCA notice
  5. Contact information - Your name, address, and telephone number
  6. Signature - Your physical or electronic signature

4.2 Counter-Notice Process

Upon receiving a valid counter-notification, we will:

  • Send a copy to the original complainant
  • Inform them that we will restore the content in 10-14 business days
  • Restore the content unless the complainant files a court action

5. ClassroomPulse Response Process

5.1 Upon Receiving a Valid DMCA Notice

  1. Remove or disable access to the allegedly infringing material
  2. Notify the user who posted the material
  3. Document the notice and our response
  4. For repeat infringers, terminate user access as required

5.2 Investigation Timeline

  • Initial review: Within 2 business days
  • Action taken: Within 5 business days for valid notices
  • User notification: Within 24 hours of action
  • Counter-notice period: 10-14 business days

6. Repeat Infringer Policy

ClassroomPulse maintains a policy for terminating users who are repeat infringers:

  • First violation: Warning and content removal
  • Second violation: Temporary suspension (30 days)
  • Third violation: Permanent account termination

School administrators will be notified of violations by their staff members. District-level violations may result in termination of the entire organization's access.

7. Educational Fair Use

7.1 Fair Use Considerations

As an educational platform, we recognize that certain uses of copyrighted material may qualify as fair use under U.S. copyright law. Factors considered include:

  • Purpose and character of the use (educational, non-profit)
  • Nature of the copyrighted work
  • Amount and substantiality of the portion used
  • Effect on the market for the original work

7.2 Educational Guidelines

While we support educational fair use, users should:

  • Use only the amount necessary for educational purposes
  • Provide attribution when possible
  • Avoid using entire works when excerpts would suffice
  • Not use materials for commercial purposes
  • Follow their institution's copyright policies

8. User-Generated Content

Users are responsible for ensuring they have the right to upload any content, including:

  • Educational materials and resources
  • Images, videos, or audio files
  • Documents and presentations
  • Third-party educational content

By uploading content, users represent that they own the content or have permission to use it.

9. ClassroomPulse Intellectual Property

All ClassroomPulse content and materials are protected by copyright, including:

  • Software code and applications
  • User interface designs and graphics
  • Documentation and help materials
  • Training videos and webinars
  • Marketing materials and website content
  • AI models and algorithms

Users may not copy, modify, or distribute ClassroomPulse intellectual property without written permission.

10. False Claims

Filing false DMCA notices or counter-notices may result in legal liability. ClassroomPulse reserves the right to:

  • Seek damages from parties who file false claims
  • Terminate accounts of users who abuse the DMCA process
  • Report false claims to appropriate authorities
  • Publicly disclose information about bad faith actors

11. Limitation of Liability

ClassroomPulse is not liable for actions taken in response to DMCA notices, including removal of content or termination of accounts. We act as a service provider under the DMCA safe harbor provisions.
